1. INTRODUCTION

We, DreamJay, Inc. (“DreamJay”) provider of the Nightly app (“Nightly”) are committed to respecting and protecting your privacy and we aim to comply with global data protection regulations.

On May 25, 2018 the Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) – (“GDPR”) will come into effect.

If you are an EU based user of Nightly this document contains key information regarding the processing of your personal data via Nightly.

This GDPR Policy together with the Privacy Policy and Terms of Service govern your use of Nightly.

DreamJay acts as a data controller of the personal data you provided when registering for or using Nightly. 5. LEGAL BASIS OF DATA PROCESSING

We process your personal data on the basis of your consent granted when registering for Nightly and accepting our Terms of Service and Privacy Policy – in order to provide you with Nightly services set out in our Terms of Service. All personal data collected by DreamJay during the registration process (described in our Terms of Service) are collected on a voluntary basis however they are necessary for the purpose of DreamJay providing the services you requested.

 

6. PERSONAL DATA RECIPIENTS

DreamJay may disclose your personal data to: (i) suppliers, vendors, service providers, payment processors and other entities who are involved in the development process of Nightly (ii) third parties to update your personal data or provide analytics concerning use, performance or improvement of Nightly, (iii) third parties in the event of reorganization, merger, sale, joint venture, assignment, transfer or disposition of all or any portion of DreamJay’s business or operations (including without limitation in connection with bankruptcy or any similar proceedings); (iv) other persons and organizations as otherwise authorized by you.

Your personal data may also be disclosed to public authorities in response to a subpoena, legal order or official request; when we believe you have acted in violation of the Terms of Service; to investigate, prevent or take action regarding suspected illegal activities, fraud or potential threats; or to exercise legal rights or defend against claims, when we believe that doing so may protect your safety or the safety or reputation of DreamJay or others, or as otherwise permitted or required by law.

 

7. PERSONAL DATA STORAGE PERIOD

We will store your personal data for the period of your subscription to Nightly or until you withdraw your consent for processing of personal data via Nightly.

 

8. YOUR RIGHTS

Under the provisions of GDPR you shall have:

  • the right to access your personal data and receive a copy thereof, i.e., to obtain information on whether we process your personal data and specific information about such processing;
  • the right to rectify (amend) your personal data, i.e., to request us to amend inaccurate personal data;
  • the right to erase your personal data, provided that one of the relevant grounds for such action apply;
  • the right to restrict the processing of your personal data, provided that one of the relevant grounds for such action apply;
  • the right to object to the processing of your personal data;
  • the right to data transfer, i.e., to receive data that you provided to us in a structured, commonly used and machine-readable format and if necessary to request us to transfer those data to another controller;
  • the right to complain to a supervisory authority; and
  • the right to withdraw consent.

Based on your personal data, we will not take automated decisions with you, including decisions resulting from profiling.

If you consider that our processing of your personal data infringes data protection laws, you have a legal right to file a complaint with a supervisory authority responsible for data protection. You may do so in the EU member state of your habitual residence, your place of work or the place of the alleged infringement.

To the extent that the legal basis for our processing of your personal data is consent, you have the right to withdraw that consent at any time. Withdrawal will not affect the lawfulness of any processing performed prior to the withdrawal.

You may exercise any of your rights in relation to your personal data by notice to us as indicated, to the address shown at the top of this GDPR Policy or by contacting our Data Protection Officer.

You may also exercise the right to withdraw your consent directly via Nightly.

Withdraw consent
